NOTICE IS HEREBY GIVEN that, under, and by virtue of, that certain findings of fact, conclusions of law, order for summary judgment, and judgment entered on October 31, 2013 (Order), a certified copy of which has been delivered to me directing the sale of the Property, as hereinafter described, to satisfy the amount found and adjudged due to said Plaintiff in the above-entitled action from Defendant; Kristin Daugherty, as prescribed in the Order, with respect to that certain mortgage executed by Edward R. Gully, III in favor of New Market Bank, a Minnesota banking corporation, dated July 6, 2006, and filed of record on August 1, 2006, as Document No. 488491.009, in the Office of the Registrar of Titles in and for Anoka County, Minnesota, the undersigned Sheriff of Anoka County, Minnesota, shall sell at public auction, to the highest bidder, for cash, on the 23rd day of January, 2014, at 10:00 a.m., at the Anoka County Sheriffs Office, 13301 Hanson Boulevard Northwest, Andover, Minnesota 55304, in the said County and State, the following premises and real estate described in said Order, commonly known as 280 Lincoln Drive Northeast, East Bethel, Minnesota 55092, PID No. 36-33-23-13-0011, and legally described as follows:
Lot 2, Block 1, Rhoden Addition, Anoka County, Minnesota.
THE TIME ALLOWED BY LAW FOR THE REDEMPTION BY THE MORTGAGOR, THE MORTGAGORS PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTE, SECTION 582,032, DETERMINING, AMONG OTHER THINGS* THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
